SMS/MMS MOBILE MESSAGE MARKETING PROGRAM TERMS AND CONDITIONS

Acceinfo Inc. (hereinafter, “We,” “Us,” “Our”) is offering a mobile messaging program (the “Program”), which you agree to use and participate in subject to these Mobile Messaging Terms and Conditions and our Privacy Policy (collectively, the “Agreement”).

By opting in to or participating in any of our Programs, you accept and agree to these terms and conditions, including your agreement to resolve any disputes with us through binding, individual-only arbitration as detailed in the Dispute Resolution section below. This Agreement is limited to the Program and is not intended to modify other Terms and Conditions or Privacy Policy that may govern the relationship between you and Us in other contexts.


User Opt-In

The Program allows Users to receive SMS/MMS mobile messages by affirmatively opting in to the Program, such as through online or application-based enrollment forms.

By participating in the Program, you agree to receive autodialed or prerecorded marketing mobile messages at the phone number associated with your opt-in. You understand that consent is not required to make any purchase from Us.

Message and data rates may apply. While you consent to receive messages sent using an autodialer, the foregoing shall not be interpreted to imply that all of Our messages are sent using such a system.


User Opt-Out

If you no longer wish to participate in the Program, reply STOPENDCANCELUNSUBSCRIBE, or QUIT to any mobile message from Us. You may receive an additional confirmation message.

These are the only reasonable means of opting out. Any other method, including verbally asking an employee or sending unrelated keywords, is not valid.


Duty to Notify and Indemnify

If you change or deactivate your mobile number, you agree to complete the opt-out process before ending its use. Failure to do so means you agree to be responsible for any resulting claims, costs, or legal fees.

You agree to indemnify, defend, and hold Us harmless from any claims related to your failure to provide such notice, including claims under the Telephone Consumer Protection Act (TCPA) or similar laws.

If your device does not support MMS, the Program will send SMS messages instead.


Disclaimer of Warranty

The Program is offered on an "as-is" basis and may not be available in all areas at all times. We are not responsible for any delays or failures in message delivery. Delivery is dependent on your carrier and network conditions.

Dispute Resolution

Any dispute arising under this Agreement shall be resolved through binding arbitration in Davao City, Philippines before one arbitrator, in accordance with the rules of the American Arbitration Association (AAA) or applicable arbitration body.

Arbitration will be conducted on an individual basis only — no class or representative actions are permitted.
